Why make a Will?
A Will is a vital armament against tax erosion of your assets on your death. If you do not make a Will, the law dictates who gets your assets and these people may not have tax exemptions and may need to sell your assets to pay any tax liability. They may also be people who you didn't intend to inherit your possessions. A Will allows you to decide to whom you wish to leave parts of your assets on your death. In some instances, the people you leave your worldly possessions to are also tax exempt and so this liability can be reduced or negated by some simple drafting in your Will.
A Will also acts as a clear expression of your wishes and desires and upon your death becomes a legally enforceable document as long as it is not void through poor drafting. It allows you to provide for your loved ones after your death and know that they are cared for.
If you have children, a Will allows you to appoint suitable Guardians to young children. In the event of you not having a Will, a Court will decide who to appoint as carers for your young children. These might not be people who you would normally have wished to take on this role and have a guiding force in the upbringing of your children.
Wills can take account of a multitude of personal circumstances which the strict application of the law would not. It is a clear and unequivocal expression of your last wishes which gain full force of law upon your death. What will it Cost?
If an enquiry is received via this website, the costs are as follows for a simple execution only Will which does not require tax planning or involve complex matters;
Single Will £95 + VAT Mirror Wills (for couples) £145 + VAT
We offer free storage if Lawcomm Solicitors are also named as one of your Executors. We also offer one minor amendment each year for free*. As an existing client you will always receive further preferential rates should you need to revise your Will. Subject to availability, we can also arrange home visits nationwide should this be necessary.
What Next?
If you now wish to make a new Will or update an existing Will, you have numerous options as follows;
- Contact the department on 0870 2400738 and arrange an appointment, or
- Complete the Wills Questionnaire and submit this by post together with a cheque made payable to 'Lawcomm Solicitors', or
- Complete the Wills Questionnaire and send this to us and we will contact you upon receipt.
Please note that all instructions are subject to agreement to our standard terms of business.
Once we receive your completed questionnaire and cleared payment we shall create a draft Will for your consideration. **Once you have agreed the draft we will then advise you on how to make the Will valid and discuss storage arrangements with you. If you are only submitting the Wills Questionnaire, we will contact you upon receiving this.
