Case Study 1:
We acted on behalf of our client in defending a boundary dispute. The allegation against our client was that he had wrongfully erected a fence over his neighbour’s land and had also curtailed a right of way. We managed to obtain expert evidence using digital mapping analysis and were able to prove that there had been no boundary or right of way infringement. The case against our client was dismissed and the neighbour had to pay our client’s costs.
Case Study 2:
We acted on behalf of our client who issued proceedings in the High Court in respect of libelous posts on social media. The posts caused our client significant harm to his reputation and his business. We managed to obtain an apology, removal of the offending posts and damages. Our client was also able to recover a majority of his costs from the losing party.
Case Study 3:
We acted on behalf of our client who owned a property with her brother. Our client was not named on the property deeds but had contributed towards the deposit and the maintenance of the property. We issued proceedings under legislation called TOLATA and obtained a declaration that her brother held 50% of the property on trust for our client and that the property should be sold with half of the proceeds being paid to our client. In view of the brother’s unreasonable conduct, we also managed to obtain an order for costs in favour of our client.
Case Study 4:
We acted for a beneficiary under a will. Our client had been the carer of the deceased. However, the deceased’s family disputed the will claiming that it was signed under undue influence. We acted for our client and were able to prove that the will was validly executed and that he was entitled to benefit from the deceased’s estate as the deceased had intended. Our client recovered a majority of his legal costs from the deceased’s family.
Case Study 5:
We acted on behalf of our client who claimed that his neighbour was causing a nuisance as a result of various acts including the piling up of rubbish and invading our client’s privacy and harassing him by positioning CCTV security cameras over our client’s property. We managed to obtain undertakings from the neighbour to cease and resist from undertaking such acts in the future and avoided court proceedings through mediation. This process resulted in less delay and costs. It also assisted the neighbours to reconcile their differences.
