Divorce
You can apply to end your marriage. Party who applies is the Applicant and the other party is the Respondent.
There is only one ground for divorce and that is that the marriage has broken down irretrievably. The Applicant has to establish this by proving one of five facts
1. Adultery and intolerability
2. The Respondent’s behaviour
3. Desertion
4. Two years’ separation with consent
5. Five years’ separation
Civil Partnership Dissolution
You can apply to end (“Dissolve”) your civil partnership. Party who applies is the Applicant and the other party is the Respondent.
There is only one ground for dissolution and that is that the civil partnership has broken down irretrievably. The Applicant has to establish this by proving one of four facts
1. The Respondent’s behaviour
2. Desertion
3. Two years’ separation with consent
4. Five years’ separation
