Energy Performance Certificates (EPC’s)
From 1 October 2008, rented homes will require an Energy Performance Certificate (EPC) in respect of all new tenancies.
At Lawcomm Solicitors, we are currently able to arrange an EPC for £55 plus VAT for properties in Southampton and £60.00 plus VAT for all other areas.
An EPC for rented property is valid for ten years. The EPC and recommendation report must be made available free of charge by a landlord to a prospective tenant at the earliest opportunity and no later than:
(a) when any written information about the building is provided in response to a request for information received from the prospective tenant; or
(b) when a viewing is conducted; or
(c) if neither of those occur, before entering into a contract to sell or let.
An EPC does not have to be made available if:
(a) the landlord believes that the prospective tenant is unlikely to have sufficient funds to purchase or rent the property or is not genuinely interested in renting that type of property; or
(b) the landlord is unlikely to be prepared to rent out the property to the prospective tenant (although this does not authorize unlawful discrimination), or
(c) in the case of an existing tenancy. However, landlords are advised to obtain an EPC so that when a tenancy ends there are no delays in marketing or accepting a new tenant.
Landlords opting to rent out their homes could face harsh financial penalties if they do not comply with the latest legislation.
